“这个玉米真的很好吃！”“这款粉底我用过，很服帖。”“主播太棒了！”……

你是否在直播间中看过这样齐刷刷的评论？但你可能想不到，屏幕上那些“好评”与“夸赞”可能是一名刷手同时操作几十个号发出来的。

引流、互动、推广、涨粉……可能都是“套路”。

近日，浙江省宁波市鄞州区人民检察院受理了浙江首批因操控软件虚增直播间人气被判非法经营罪的案件。其中，王某被检察机关提起公诉后，最终以非法经营罪被判处有期徒刑一年三个月，缓刑一年六个月，并处罚金人民币5万元。

直播间的观众是“假人”？

“只要你买个手机建个机房，再利用软件操纵手机，自动进入某个指定的直播间，不需要做什么，只要手机在直播间里面‘挂着’账号吸引人气，就能赚钱……”2022年年底，一次偶然的机会，王某从朋友处听说直播间刷流量“助阵”非常赚钱。

王某听后很心动，立刻向长沙某科技公司购买了大量手机、路由器、交换机等网络设备、翻墙工具和“云控软件”，在鄞州区多地设立群控机房，雇佣杨某某等人为工作人员，操作接单系统和群控软件。想着能大赚一笔，“豪气”的王某还邀请了张某等几名好友一起“大干一场”。

近年来，“网络水军”的违法活动呈现出一些新的特点。与以往“拉人头”进入直播间增加人气的形式不同，王某只需要在电脑上使用“云控软件”，就能操控机房里上千部手机自动进入指定直播间，并进行关注、点赞、评论等任务。在软件的操纵下，几百甚至几千部手机瞬时涌入同一个直播间，原本只有个位数的人气立刻暴涨，顺势吸引更多“野生”流量。

在王某的工作室里，有一个实体机房，密密麻麻地排列着几千部手机，一旦接到增加虚假人气的订单，王某就利用操控软件，让机房里的大量手机进入指定直播间“充人头，增人气”，最后再按进入直播间的时间和手机数量结算非法获利。

一番操作看似简单粗暴，背后收入却相当暴利，王某交代：“一台手机每天收费6.65元，两个工作室加起来差不多有4600台手机，断断续续工作了三四个月”。在2022年11月至2023年3月，不到4个月的时间里，收入近300万元。

经查，这些操控手机所登录的短视频平台直播间账号均系王某从他人处批量购买所得，未经过直播平台实名认证，为虚假账号。但即使被平台查封，只要重新注册就能卷土重来。

对此，案件承办检察官表示：“直播平台账号管理存在一定的漏洞，虚假账号买卖现象猖獗，导致犯罪分子有隙可乘。而且犯罪团伙能够低价购进数千部手机用于操控，其手机收购来源存疑，这也暴露出手机回收市场可能存在违法犯罪活动。”

那么，王某利用操控软件虚增人气的行为应当如何定性呢？

鄞州区人民检察院承办人表示，王某等人违反国家规定，以营利为目的，使用批量操控软件，向他人有偿提供发布虚构的评论、点赞等服务，扰乱市场秩序，可以认定为《关于办理利用信息网络实施诽谤等刑事案件适用法律若干问题的解释》第七条规定的“明知是虚假信息，通过信息网络有偿提供发布信息等服务”，应以非法经营罪定罪处罚。

在办理王某等人非法经营案过程中，鄞州区人民检察院履行法律监督职责追诉漏犯8人，该系列案共有17人进入检察院审查起诉阶段，目前10人已获得法院有罪判决，其中王某被检察机关提起公诉后，最终以非法经营罪被判处有期徒刑一年三个月，缓刑一年六个月，并处罚金人民币5万元。

网络空间不是法外之地

虽然“网络水军”早已不是什么新鲜之事，但这些年其随着互联网的发展而野蛮生长，从一开始的“单兵作战”逐步变成“规模团战”。

“网络水军的行为方式有很多种，除了在直播带货中‘刷人气’、在购物网站‘刷好评’，还有发布侮辱、诽谤等信息的网络暴力型；或受企业或个人雇佣对负面信息、评论进行有偿删除的类型；有的则是造谣传谣型，编造虚假吸引人眼球的信息或谣言，来实现炒作、引流等目的。”相关检察干警介绍。

对此，检察官提醒，网络空间不是法外之地，“网络水军”的行为不仅违法，而且可能涉嫌刑事犯罪。日常生活中，消费者及当事人如果发现这些违法违规行为，可依法向相关平台或管理部门及时举报。

"As long as you buy a mobile phone and build a data center, and then use software to manipulate your phone to automatically enter a designated live broadcast room, you don't need to do anything. As long as your phone 'hangs' an account in the live broadcast room to attract popularity, you can make money..." At the end of 2022, by chance, Wang heard from a friend that the live broadcast room was very profitable by "assisting" with traffic.

After hearing this, Wang was very tempted and immediately purchased a large number of network equipment such as mobile phones, routers, switches, and cloud control software from a technology company in Changsha. He set up group control computer rooms in multiple places in Yinzhou district and hired Yang and others as staff to operate the order receiving system and group control software. Thinking of making a big profit, Wang, who was known for his boldness, even invited Zhang and several other friends to join him in a big fight.

In recent years, the illegal activities of the "online water army" have shown some new characteristics. Unlike the previous way of "pulling people into the live broadcast room to increase popularity," Wang only needs to use "cloud control software" on his computer to control thousands of mobile phones in the computer room to automatically enter the designated live broadcast room and perform tasks such as following, liking, and commenting. Under the manipulation of software, hundreds or even thousands of mobile phones instantly flood into the same live broadcast room, causing the once single digit popularity to skyrocket and attract more "wild" traffic.

In Wang's studio, there is a physical data center densely packed with thousands of mobile phones. Once he receives an order to increase false popularity, Wang uses control software to allow a large number of mobile phones in the data center to enter the designated live broadcast room to "fill the head and increase popularity", and finally settles illegal profits based on the time and number of phones entered the live broadcast room.

The operation seemed simple and crude, but the income behind it was quite lucrative. Wang explained, "A phone charges 6.65 yuan per day, and the two studios combined have about 4600 phones, working intermittently for three to four months.". In less than four months from November 2022 to March 2023, the income was nearly 3 million yuan.

After investigation, it was found that the short video platform live streaming room accounts logged in with these mobile phones were all purchased in bulk by Wang from others and did not undergo real name authentication on the live streaming platform, making them false accounts. But even if it is banned by the platform, as long as you re register, you can make a comeback.

In response, the prosecutor in charge of the case stated, "There are certain loopholes in the management of live streaming platform accounts, and the phenomenon of buying and selling fake accounts is rampant, leading to loopholes for criminals. Moreover, criminal gangs can purchase thousands of mobile phones at low prices for manipulation, and the source of their mobile phone purchases is questionable, which also exposes the possibility of illegal and criminal activities in the mobile phone recycling market."

So, how should Wang characterize his behavior of using control software to artificially increase popularity?

The person in charge of the People's Procuratorate of Yinzhou District stated that Wang and others violated national regulations, used batch manipulation software for the purpose of profit, and provided paid services such as publishing fictitious comments and likes to others, disrupting market order. This can be regarded as Article 7 of the "Interpretation on Several Issues Concerning the application of law in Handling Criminal Cases of Defamation and Other Crimes through the Use of Information Networks", which stipulates that "knowingly providing paid services such as publishing information through the information network while using false information", and should be convicted and punished for the crime of illegal business operations.

In the process of handling the illegal business case involving Wang and others, the People's Procuratorate of Yinzhou District fulfilled its legal supervision responsibilities to prosecute 8 missing offenders. A total of 17 people in this series of cases have entered the procuratorate's review and prosecution stage. Currently, 10 people have been convicted by the court. Among them, Wang was prosecuted by the procuratorial organs and ultimately sentenced to one year and three months in prison, suspended for one year and six months, and fined RMB 50000 for the crime of illegal business.

In this regard, prosecutors remind that cyberspace is not an extralegal space, and the actions of the "cyber navy" are not only illegal, but may also be suspected of criminal offenses. In daily life, consumers and parties involved can report these illegal and irregular behaviors to relevant platforms or management departments in a timely manner in accordance with the law.
